1. Validity of the GTC
The GTC apply to all services provided by Adrian & Diego MATHIER NOUVEAU SALQUENEN AG and become valid in the version valid at the time of the order when a contract is concluded. Any provisions of the contracting party that may differ from these terms and conditions shall therefore be invalid. By sending an order to Adrian & Diego MATHIER NOUVEAU SALQUENEN AG, the customer confirms that he has read these terms and conditions and expressly agrees to them.
2. Conclusion of a contract
Sales contracts are concluded when Adrian & Diego MATHIER NOUVEAU SALQUENEN AG accepts the order. The customer will receive an e-mail confirming acceptance of the order, which is then binding. The customer will also be informed by e-mail as soon as possible of any obstacles to delivery. By placing an order, the customer confirms that he is clear about the scope and content of his order. Questions in this regard can therefore be clarified with us in advance.
3. Deliveries
The delivery of the goods is generally carried out by the postal service or a transport company. If, in exceptional cases, an item in our range is not available, the customer will be informed of this as soon as possible by e-mail. In principle, we reserve the right to make a partial delivery if this seems to serve the fastest possible processing of the entire delivery. We also reserve the right to only fulfil an order to the extent that the items are available.
In principle, the stated readiness for dispatch of the items is an estimate based on experience and is therefore not binding for Adrian & Diego MATHIER NOUVEAU SALQUENEN AG.
4. Prices
We always try to offer our customers the best possible price for our products, but this is closely linked to the prices of our suppliers. Adrian & Diego MATHIER NOUVEAU SALQUENEN AG therefore expressly reserves the right to adjust the prices stated online without prior notice and without further explanation. The principle of calculating prices at the time of the order on the website applies to the order and delivery.
5. VAT
The prices for Switzerland and the Principality of Liechtenstein include the statutory value added tax of 8.1%. Our VAT number is CHE -106.817.371.
6. Customs duties for customers abroad
Orders on www.mathier-shop.com are only shipped to Switzerland and the Principality of Liechtenstein.
7. Prices
Prices are stated in Swiss francs and are to be paid in Swiss francs.
8. Returns
In principle, the right to return the ordered goods exists only in the case of incorrect delivery by Adrian & Diego MATHIER NOUVEAU SALQUENEN AG, production defects or transport damage that has occurred in the course of delivery. We therefore expressly ask our customers to promptly check the received delivery for any defects upon receipt. Adrian & Diego MATHIER NOUVEAU SALQUENEN AG must be informed immediately of any errors or defects in the delivery. If there is a defect or damage for which Adrian & Diego MATHIER NOUVEAU SALQUENEN AG is responsible, Adrian & Diego MATHIER NOUVEAU SALQUENEN AG is entitled to decide at its own discretion whether to exchange the goods or rectify the defect. The goods must be returned in their original packaging, unused and complete.
In the event of an incorrect delivery, Adrian & Diego MATHIER NOUVEAU SALQUENEN AG agrees to deliver the correct item(s) to the customer if possible, or otherwise to settle the order for a corresponding replacement (at the customer's option) of the same value. It is not possible to cancel the order as long as the ordered item is available.
Defective or damaged items will be examined by us in principle for the corresponding defects, in order to ensure the warranty claim. Damage caused by defective materials or manufacturing defects will be handled by Adrian & Diego MATHIER NOUVEAU SALQUENEN AG in accordance with the provisions for incorrect delivery. In principle, a cancellation of the contract will not be granted in the event of the above incidents.
A refund will be given for corked wines, provided that the defect is identifiable and the bottle is at least 75 per cent full. If the same vintage is still available, the corked wine will be exchanged; otherwise, it will be refunded in the form of a voucher. This regulation is valid for three years from the date of purchase. This does not apply to wines that have been sealed with synthetic corks or screw caps or wines that have exceeded the recommended drinking age.
In the event of damage during transport, a report with detailed information about the damage must be sent by email to info@mathier.com within 48 hours of receipt of the goods, otherwise the right to a free replacement will expire.
In the event of an incorrect return, any costs incurred by Adrian & Diego MATHIER NOUVEAU SALQUENEN AG in the course of the return will be charged to the customer.
The customer is granted a period of 5 working days from receipt of the goods within which the goods can be returned together with the notice of defect.
Please note that a return will never result in a refund as long as the ordered goods are available. We reserve the right to refund the corresponding value of the goods by means of a voucher or an equivalent item.
The shipping costs are generally to be paid by the customer. Unfortunately, insufficiently stamped returns cannot be processed. The shipping costs will only be refunded to the customer if the delivery is a wrong delivery, from Adrian & Diego MATHIER NOUVEAU SALQUENEN AG, or if there is production or transport damage.
Due to the high price reduction, an exchange is not possible for written-off items.
9. Care/handling of the wines
Adrian & Diego MATHIER NOUVEAU SALQUENEN AG does not accept any liability for customer misconduct in the care and/or handling of the delivered items. We therefore ask customers to observe the relevant instructions.
10. Payment options
The customer can choose from the payment options offered during the order process.
Adrian & Diego MATHIER NOUVEAU SALQUENEN AG is the direct point of contact for customers who shop in the online store for billing and payment questions.
Adrian & Diego MATHIER NOUVEAU SALQUENEN AG reserves the right to exclude customers from individual payment options or to insist on advance payment without stating reasons. If advance payment is made, the amount must be transferred within 15 working days.
Adrian & Diego MATHIER NOUVEAU SALQUENEN AG may charge default interest of 7% per year and a reminder fee of up to CHF 20 per reminder if the customer is in default of payment. If debt enforcement proceedings are initiated, the customer will be charged a processing fee of CHF 100.
11. General liability
We hereby expressly state that no liability claims can be asserted against Adrian & Diego MATHIER NOUVEAU SALQUENEN AG.
12. Reservation of title
The goods supplied remain the property of Adrian & Diego MATHIER NOUVEAU SALQUENEN AG until full payment has been received.

15. Applicable law/Place of jurisdiction
In all cases, the relationship between the client and Adrian & Diego MATHIER NOUVEAU SALQUENEN AG is subject to Swiss law in accordance with the provisions of the Swiss Code of Obligations and the Swiss Civil Code, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the location of Adrian & Diego MATHIER NOUVEAU SALQUENEN AG.
